If an applicant’s previous degree program was not as good as the one they are applying for, IRCC may reject the applications for a Study Permit. Denial of their study visa application may result from poor performance in their intended major subjects.
In the Canadian case Barot vs. Canada (Citizenship and Immigration), a 23-year-old Indian national filed the application. After the Immigration and Refugee Control Board turned down his study permit application, he sued for judicial review.
Having graduated from the University of Mumbai with a Bachelor of management studies degree in 2020, the applicant is seeking to further her education. For the post-graduate certificate in entrepreneurial management offered by Canadore College, the applicant applied for a study permit in 2021.
Among the materials submitted along with the application was a letter of acceptance from Canadore College, transcripts, and a letter of recommendation from the applicant’s present employer.
Study permission was denied by the visa officer for the applicant, although Canadore College accepted him. His decision was based on his argument that the applicant would not be able to complete his studies in Canada without a strong academic background. In prerequisite courses, the applicant’s transcripts indicate below-average grades. Upon reviewing the applicant’s program of study, the official determined that the applicant wasn’t actually enrolled in a university.
Additionally, the Court did not require the visa officer to explain why he or she thought the student’s grades were too low, despite the fact that the applicant had been accepted to a Canadian post-secondary institution. By this ruling, visa officers may have fewer discretions when rejecting applications. Additionally, if you have low grades, it is important to explain why it will not (or will not) prevent you from completing the programs you recommend.
Ways to submit applications for the study permit
Canadian study-abroad destinations are incredibly popular due to the country’s excellent standard of education, the fact that international students can work while they study, and the ease of obtaining permanent residency.
A prospective student must meet the given requirements to apply for a study permit:
- Select an educational institution and request an admission letter.
- Make sure you must have enough funds to complete a student’s first year of tuition, living expenses, and return airfare.
- It is essential that you obtain a CAQ before studying in Montreal or anywhere else in Quebec.
- An impeccable track record. If an applicant has a criminal history or constitutes a security threat to Canada, they may be rejected. Police clearance certificates may even be required by the IRCC.
- Maintain a healthy lifestyle. Medical examinations might be required by IRCC if they ask applicants to do so.
- Upon expiration of the authorized period per the study permit, inform the immigration official that you will depart Canada.
If you have a LOC from a school, you should apply for a student permit as soon as possible because processing times vary.
Student Direct Stream
Using the Student Direct Stream (SDS) program, some international students can more quickly and easily apply for a Canadian study permit. The SDS is available to residents from 14 countries:
- Vietnam
- Costa Rica
- Antigua and Barbuda
- Trinidad and Tobago
- Philippines
- China
- St. Vincent and the Grenadines
- Pakistan
- India
- Costa Rica
- Peru
- Colombia
Applications eligible for SDS will be processed within 20 days. To apply for a Canadian study permits through the SDS, prospective students must meet the following requirements:
- Submission of a copy of the admission letter issued by a designated learning institution in Canada is required.
- Provide documentation verifying the completion of the applicant’s initial medical examination.
- Demonstrate possession of a Guaranteed Investment Certificate (GIC) worth $10,000.
- Present evidence of payment for the first year’s tuition fees.
- Submit language test results, taken within the past two years of the SDS application, indicating an IELTS score of 6 in English or an NCLC 7 in French.
- It is necessary to visit a Visa Application Centre to formally submit the application.
