What is Labor Market Impact Assessment?
Canadian employers can hire workers through the Temporary Foreign Worker Program (TFWP). They require an LMIA before hiring a temporary foreign worker. LMIA is a document that shows that a foreign worker is required to fill the vacant job posts and there is no availability of a Canadian worker to do the job. The Immigration Ministry of Quebec provides an updated list of occupations every year. An employer would not have to advertise an open position for such occupations before hiring a temporary foreign worker. These occupations are eligible for simplified processing under the LMIA process. Last year, Quebec made a minor change by updating the list of occupations on a regional level. However, this year the government has gone back to a provincial list of occupations that are based on labor shortages in all regions of the province rather than being a region-specific list. This year, 116 new occupations have been added to the list while removing the nine occupations that were present last year. The 116 occupations that are newly added recently include positions in architecture, human resources, investment managers, bakers, dentists, and others. The list of occupations that are based on the National Occupational Classification (NOC) system for the Facilitated Labor Market Impact Assessment is conducted by Emploi-Quebec in collaboration with the Immigration Ministry of Quebec.New Facilitated LMIA list
Canadian employers have to apply for Labor Market Impact Assessment before they hire foreign workers. In this assessment, they must show that they have advertised an open position for at least 28 days and have interviewed eligible candidates. However, no Canadian citizen or permanent resident is available to fill the vacant position. But there are some positions in Quebec that do not require proof of recruitment activities. Thus, Canadian employers can fill a simplified application and this procedure is known as a “facilitated LMIA”. The nine occupations that have been removed by the Quebec government for the facilitated LMIA are:- Supervisors, furniture and fixtures manufacturing (9224)
- Supervisors, mineral and metal processing (9211)
- Contractors and supervisors, other construction trades, installers, repairers and servicers (7205)
- Cardiology technologists and electrophysiological diagnostic technologists (3217)
- Professional occupations in advertising, marketing and public relations (1242)
- Statistical officers and related research support occupations (1254)
- Recreation, sports and fitness program and service directors (0513)
- Massage therapists (3236)
