According to recent information by IRCC, a new work permit method is being considered for TWFP participants.
A new work permit will be granted to foreign workers who already possess a work permit for Canada and are applying for a new one. It allows them to pursue the same profession with the same employer. The policy took effect in December 2022.
IRCC has not validated this information, so whether the plan will move forward is unknown.
Reduction of inventories by the IRCC
An action plan being developed by the IRCC aims to lower inventories and improve customer service. As well as eliminate employment shortages in Canada as quickly as possible. In addition to simplifying TFWP work permit renewal procedures, ESDC – (Employment and Social Development Canada) has the mandate to reduce administrative burdens.
New procedures involve pulling applications daily and placing them in designated folders through the GMCS – (Global Case Management System). According to IRCC, there will be no automation of the process.
The decision to grant a work permit typically is made by an officer after each applicant has been assessed separately. Applicants must submit information about their training, language skills, and relevant licenses.
A legitimate job offer will also be confirmed by the officer. A good employer must be economically active, financially stable, and comply with local and federal employment laws.
No matter where the applicant is applying, whether in Canada or abroad, they will have to comply with the new policy if they are returning to the same employer and occupation.
New TWFP work permit method – Who is qualified for it?
During the period January 2017 – August 31, 2022, based on data from the ATIP, the IRCC is expected to receive 71,955 applications from foreign workers in the same profession and employers who have multiple work permits under the same employers. The department anticipates that these measures will be useful.
It is necessary for candidates to meet the following criteria in order to be eligible:

- The work permit has to be issued once every five years and there must be no discrepancies from the prior work permit.
- To receive a work permit that is particular to their workplace, they must fill out an application.
- Their NOC – (National Occupation Classification) code must be the same as when they left.
- As part of their new application, they will need to provide biometrics.
- Aside from meeting all admissibility requirements, they must also adhere to all other screening requirements.
Temporary Foreign Workers Program – An overview
Often, there are not enough or the right candidates for open positions at Canadian firms, so the Temporary Foreign Worker Program (TFWP) is used to fill the position. A closed work permit is issued to TFWP-eligible workers. Workers that qualify for the TFWP are given a closed work permit. As a result, individuals are limited to working for one company in Canada.
LMIA – (Labor Market Impact Assessments) are required for a majority of TFWP employees. The employer has submitted a submission to ESDC explaining the reasons why they intend to hire foreign workers. If foreign labor is employed, it must show how it boosts the Canadian economy, or if it doesn’t boost it at all.
A company must prove that it first sought to fill the vacant positions with competent Canadians or permanent residents before hiring foreign workers.
Furthermore, employers may check whether an employee is complying with legal requirements after they begin working in Canada.
