The Canadian government provides a sponsorship program for those permanent residents and Canadian citizens who want to sponsor their spouse or partner to obtain permanent resident status in Canada. Candidates have to make a promise that they will provide financial support and basic needs for their partner by signing an undertaking.
Basic needs contain given below things:
- Clothing, a roof, food, and everything which is required to fulfill everyday living needs.
- Any healthcare which does not fall into the public health services such as Dental care, eye care, etc.
Sponsors have to make sure that sponsor partners will not be required to seek financial help from the government, before signing the agreement of undertaking. If your partner is required to take help from the government, you will be responsible for it and you have to pay back that amount to the government.
The undertaking refers to an application that is important to make unbreakable promises of support. This holds you responsible for supporting your partner for the length of the period of the undertaking, the length of your undertaking depends on the age of your partner, their relationship with you, and where they live. The undertaking will be effective even if:
- Your sponsor partner becomes a citizen of Canada.
- If you are separated, divorced, or breaking your relationship with your partner.
- If you or your partner left the country or moved to another country.
- If you face financial problems.
The duration of the undertaking
For Quebec residents, the length of the undertaking is different from the rest of the Canadian residents. For sponsors who sponsor their partner or common-laws, their undertaking duration will be 3 years from the day sponsoring person obtains permanent resident status, but for people of Quebec, the duration of the undertaking will be different.
Also, for sponsors who sponsor their dependent child who is above 22 years old the duration of the undertaking will be 3 years. If the age of the dependent child is below 22 and you want to sponsor them then the duration of the undertaking will be 10 years from the day, they get PR status in Canada or till the child turns 25, whichever is earlier.
Am I able to cancel my undertaking?
Sponsors who want to cancel their undertaking of their partner or common-laws, candidates have to write a letter to IRCC before the final decision by the officer of IRCC of your undertaking file. The cancelation of your undertaking shall be permitted when it is approved by the officer of IRCC.
